A man who broke a broomstick in half before stabbing his ex-girlfriend in the head has avoided jail.

Dino Roberts, 37, was charged with aggravated assault occasioning bodily harm and 23 breaches of a family violence restraining order.

Roberts appeared in Western Australia‘s Kalgoorlie Magistrates Court on Thursday where details of his crime were heard.

The 37-year-old had attacked his partner after finding messages from another man on her phone in February. The pair had recently split before the attack.

He struck her arm with the broomstick before snapping it in half and stabbing the top of her head, leaving her with a 1cm-2cm cut, the West Australian reported.

The court heard Roberts also called his ex 60 times from jail between June and July, which breached the family violence order. 

His defence lawyer Tenaiya Dickerson said while there was no excuse for his actions, the attack stemmed from the rage Roberts felt at his ex moving on with another man.

She claimed the dozens of calls from jail were Roberts trying to speak to his three children.

The defence unsuccessfully argued against Roberts being declared a serial family violence offender, claiming it would carry more of a burden as an Aboriginal man.

Magistrate Paul Lyons granted the declaration and sentenced Roberts to nine months imprisonment which was suspended for 12 months.
